Drunk Driving arrests on Arizona highways are an all too common occurrence. In fact, alcohol impaired driving is a menace on highways across our country. In an effort to curtail the growing problem of impaired driving, Arizona law enforcement and legislative bodies have made the punishments for DUI’s in the state harsh and unforgiving. With close to 1000 drinking and driving related fatalities, it is no wonder that the laws enacted by Arizona are so stringent.
Among those laws is a statute that dictates that any person convicted of a 1st offense DUI is required to have an ignition interlock device (IID) installed in any vehicle they drive for a full year. Along with large fines for DUI offenses and the possibility of jail time, the Ignition Interlock laws that Arizona has in place are aimed at decreasing the alarming amount of drivers who take to the road under the influence of drugs or alcohol.
In order to insure that all individuals who get behind the wheel of an automobile are held responsible for their actions, Arizona has enacted an “implied consent” law that states that anybody who is operating a vehicle is subject to a test of their blood or breath for alcohol content , and that the arresting officer has the discretion to choose which test to administer. If the accused refuses to take a chemical test of their blood or breath, their license will be suspended for one year if a first offense, or two years if a second offense (within 5 years of a prior DUI offense).
