New York Ignition Interlock Laws

New York is one of the major metropolitan locations in the United States. As one of the world’s great cities, it is a hub for the arts, culture, finance, and technology. The state is also densely populated, especially New York City where millions commute to and from work on a daily basis. It is no surprise that a big city like New York is not immune to the nationwide issue of Driving While Intoxicated.

In 2008 New York had more than 28,000 DWI arrests on its highways. With hundreds more lost in alcohol related auto accidents, the state is clearly not immune from the nationwide issue of drunk driving. The prevention of impaired driving is critical to reducing alcohol-impaired-driving deaths and injuries. More than 1.46 million drivers were arrested in the United States in 2006 for driving under the influence of alcohol or narcotics. This number represents an arrest rate of one DWI arrest for every 139 licensed drivers in the United States (NHTSA, 2008b).

In an effort to curtail that figure and give law enforcement bodies the resources they need to battle drunk driving, New York has enacted some of the most stringent DWI laws of any state in the US. New York’s philosophy when it comes to the administration of Ignition Interlock Devices is to leave the power with the DWI judges who are hearing each individual case. This allows the judge to take each case on its own merits and determine if IIDs are necessary on a case by case basis.

The language of New York’s Ignition Interlock Device Laws is simple:

“Ignition interlock is required for all offenses during period of license revocation or a minimum of 6 months and thereafter by court order.”

Judges involved in DWI cases will examine the facts and determine if IIDs are necessary. Individuals who refused alcohol testing at the time of arrest, had an unusually high BAC, or injured innocent people in their alcohol related driving accident are much more likely to have IID requirements placed on them.
