The language of New York’s Ignition Interlock Device Laws is simple:
“Ignition interlock is required for all offenses during period of license revocation or a minimum of 6 months and thereafter by court order.”
Judges involved in DWI cases will examine the facts and determine if IIDs are necessary. Individuals who refused alcohol testing at the time of arrest, had an unusually high BAC, or injured innocent people in their alcohol related driving accident are much more likely to have IID requirements placed on them.
